Accidents resulting in serious personal injury can happen at any time and under any circumstances. Whether driving in your car, walking down the street, or otherwise going about your daily life, an accident can happen without a moment’s hesitation. When those accidents are the result of carelessness, negligence, or recklessness by another party, you may be entitled to financial compensation to cover financial and physical losses.

At Pettit & Cowherd Law Firm, we represent clients in a wide range of personal injury claims. Based in Aurora, Monett and Mt. Vernon, our law firm handles claims for clients throughout Southwest Missouri.

What We Do

In the aftermath of an accident, you may be feeling overwhelmed and unsure about what to do next. It is in your best interest to consult with a skilled Aurora, Monett and Mt. Vernon personal injury lawyer. Without the help of an attorney, you could be left with medical bills, lost wages, and other related expenses at no fault of your own. The insurance company may not have your best interests in mind, but we do.

At Pettit & Cowherd Law Firm, we handle personal injury cases involving:

Missouri Personal Injury Statute of Limitations

A statute of limitations is the time limit that states place on a victim's ability to file a personal injury lawsuit following their accident. This time limit can vary from state to state.

According to Missouri Code Section 516.120, individuals who have been injured and wish to file a personal injury lawsuit must do so within 5 years of the date of their accident. Victims who fail to file their claim within the specified time-frame risk having their case dismissed by the judge.

In light of these restrictions, it's important that you contact a personal injury lawyer as soon as possible following your accident. While the Missouri statute of limitations is longer than the average limit, filing a lawsuit takes time and planning, which should be taken into consideration when determining how soon to file your claim.

Does Missouri Enforce Damage Caps for Personal Injury Cases?

A damage cap is a monetary limit that is placed on how much a victim may receive in compensation for certain damages as a result of their injury. In Missouri, injury victims are limited in how much financial compensation they may receive for medical malpractice cases. Currently, the damage cap for most medical malpractice cases stands at:

  • $400,000 limit for most cases
  • $700,000 limit for catastrophic cases

Information about Missouri's damage caps for medical malpractice can be found in Missouri Revised Statutes, Section 538.210.1.
